PDS Sound and Lighting Hire
1. DEFINITIONS AND LAW
“PDS” refers to PDS Sound and Lighting Ltd.
“The Equipment” shall mean goods, components and other items hired from PDS.
“Consequential loss” shall mean loss of profits, contracts or other consequential loss or damages whatsoever.
The Contract shall be interpreted and applied in accordance with English Law
2 HIRE TERMS
All hire charges commence from the date stated in the contract and are payable for the period of hire.
The hired equipment must be returned on the date specified in the Contract in a clean and serviceable condition.
Should the equipment not be returned on the specified date, additional daily charges accrue at the full daily hire rate.
The signatory to the contract warrants that they are duly authorised on the Customers behalf to enter into the contract.
Customer’s responsibilities
The Customer’s responsibility for the Equipment commences on receipt of the Equipment by the Customer or his agent or on delivery and ends when the Customer has receipted the return of all the Equipment to PDS.
The Customer shall not at any time sell, dispose or otherwise part with control of the Equipment or attempt to do so.
The safety of the customer is paramount, therefore the Signatory to the Contract and the Customer jointly and severally undertake with PDS that everyone who uses the Equipment has been properly instructed in its safe and proper operation and will ensure that every user is in possession if necessary instructional manuals.
The Customer will at all times fully indemnify PDS against any expenses liability financial loss claim or proceedings whatsoever in respect of any personal injury or damage to or loss of any property arising out of or in connection with the delivery, hire, use, non-use, collection, return or non-return of the Equipment.
Nothing in this clause shall affect the statutory rights of the Customers or purport to exclude any liability which may not be excluded under the Unfair Contract Terms Act 1977.
All the electrical Equipment must be used with the plugs and/or sockets as fitted.
The Customer shall be responsible at all times to arrange a proper supply of electricity for use with the Equipment and ensure that the Equipment shall at all times be properly earthed.
The Customer shall ensure that the Equipment remains serviceable and clean during the hire period.
Should any breakdown or unsatisfactory working of Equipment occur, immediately notify PDS.
The Customer shall under no circumstances attempt to repair the Equipment without prior authorisation.
If the Equipment is involved in any accident resulting in damage to either the Equipment or other property or injury to any person, immediately notify PDS.
For safety, the Customer shall ensure that the Equipment is compatible and may safely be used with any other Equipment being used by the Customer.
The Customer is responsible for ensuring that any Equipment is suitable for their purposes.
The Customer is fully responsible for care safe keeping and return in good order of the equipment.
The Customer agrees to pay PDS the full retail cost of any Equipment lost stolen or damaged beyond economic repair (without deduction for usage wear tear or age)
The Customer will reimburse all costs incurred PDS in rectifying the condition of any Equipment returned damaged or unclean.
PDS shall be entitled to terminate the contract with immediate effect and to repossess the Equipment if at any time the Customer is in breach of these terms and that the Customer herby authorises PDS to deduct any sums properly arising under a breach of these terms from any credit card or debit card details which are in the possession of PDS.
PDS’s liability for any defect in the equipment shall be limited to and in no case exceed:-
a) any manufacturer’s warranty sold with the equipment; or if there shall be none
b) replacement or repair of the defective equipment
Nothing in these terms and conditions shall make PDS liable for any consequential loss to the Customer including any expense liability loss claim or proceeding whatsoever caused by or arising out of the late delivery non delivery unsuitability incompatibility or unlawful repossession of the Equipment or any part thereof or any breakdown or stoppage of the same
Nothing in these terms and conditions shall make PDS liable for any loss other than that which directly arises from any injury to persons or damage to tangible property where and only to the extent that such injury or damage is caused by any defects in the Equipment and where such defect is caused by PDS.
The Customer should be aware that playing or showing copyright material in circumstances where the Customer or anyone authorised by him does not hold the appropriate Licence of the copyright holder he will infringe copyright and may become liable in damages for so doing.
PDS Terms and Conditions (Hire)
Ownership of Equipment
The equipment remains the property of PDS. A hirer cannot lend lease or sell the hired equipment. PDS reserve the right to not release goods to persons collecting equipment
Delivery / Collection
Collection for Venues Post event
The equipment needs to be available for collection at its allotted time.
If the equipment is not available the driver will not be able to wait and the hire will the go onto its next hire period you will also be required to make your own arrangements for the return of the equipment at your cost.
Signing and responsibilities
The person signing the agreement is responsible for the equipment during the hire period and to ensure it is returned on the agreed date
Use of equipment
If Plugs are remove there is a £10.00 Charge
Change of equipment
We reserve the right to substitute equipment, we will however supply equipment of equal quality or better
Hire Period
Hire period commences when the equipment is removed from the premise or if delivered when equipment is delivered at the venue.
Hire period ends when equipment is retuned or collected at the agreed time
Payments
Deposits are not refundable
25% deposit on booking
Delivery Paid in full 14 days prior to event
Collection to be paid on collection by card or cash
